This privacy policy (“Privacy Policy”) describes how Pitcher AG (“Pitcher” or “us”/”we”) as data controller collects and uses the Personal Information you provide on our website Pitcher | Sales Enablement & Closed Loop Marketing Solution (“Website”).
Personal Information (also personal data) means information relating to an identified or identifiable natural person who can be identified, directly or indirectly, by reference to an identifier such as a name, an email address, location data, or other factors specific to that person.
This Privacy Policy also describes the choices available to you regarding our use of your Personal Information. It also provides information about your rights and how you can exercise them. The use of information collected through our Website shall be limited to the purpose of providing the Services for which Pitcher clients (“Client” or “Customer”) have engaged Pitcher. Information provided to Pitcher by our clients is collected by those clients under their own privacy policies.

This Privacy Policy describes Pitcher’s principles in terms of respecting your privacy. Pitcher works internationally and does its best to follow the privacy standards set out by all the applicable laws. In particular, the rules set in this policy are the reflection of:
- Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation; GDPR)
- Federal Act on Data Protection (FADP) of 19 June 1992 (also the new FADP, effective as of September 2023).

In most cases, in order to achieve the above-mentioned purposes, we will process your contact details, such as name, e-mail address, phone number.
It is likely that we will need to process more of your personal data when providing specific Services to you. Detailed information on what data we will process and how we will process it will be provided to you in a separate information clause available prior to data collection.
Legal basis
Pitcher processes your personal data only if it has a legal basis. In other words, we only process your data if we are sure that we can do it legally.
In most cases Pitcher will process your data based on:

- the contract that connects us with you (pursuant to Article 6.1.b) of GDPR)
- our legal obligation (pursuant to Article 6.1.c) of GDPR)

Consent
Processing will take place on the basis of your consent only once you give it to us. Giving consent will usually mean checking the checkbox in which, for example, we will offer to send you our newsletter and marketing information. If you tick the checkbox, you give us your consent and we will send you a newsletter.
Contract
If you register to our services, we conclude a contract with you. By providing you with the services, we process your data on the basis of the contract that binds us.
Legal obligation
In certain situations, Pitcher may be required to disclose personal data in response to lawful requests by public authorities, including meeting national security or law enforcement requirements. Then our legal basis will be a request or a legal provision that forces us to do so.

Sometimes we will process your personal data due to the implementation of goals closely related to our business, e.g.:

When processing your data basing on our legitimate interest, we make sure that our actions will not limit nor significantly impact your rights and freedoms.
Your rights
If Pitcher processes your personal data as a data controller, you have the right to:

When Pitcher is a data controller it means that we determine the purposes and means of the processing of Personal Data.
Request Personal Information
Upon request Pitcher will provide you with information about whether we hold any of your Personal Information. If your Personal Information changes, if you deem it not correct, or if you no longer desire our Service, you may correct, update, amend, delete, by contacting us at privacy@pitcher.com or by contacting us by telephone or postal mail at the contact information listed below. We will respond to your request within a reasonable timeframe.
Refusal of Provision, Correction or
Deletion of Personal Information
In case Pitcher responds that you haven’t provided sufficient information to confirm your personal identity in order to fulfill your request concerning your Personal Information, Pitcher will provide you with an explanation as to why the information provided wasn’t sufficient to fulfill the request.
Copy of Corrected Personal
Information, Confirmation of Processing Restrictions
In case Pitcher has updated your Personal Information upon your request, a copy of the updated Personal Information will be sent to you by the means you have requested to be provided with. In case you have requested that processing of your Personal Information is restricted, Pitcher will provide you with a confirmation of the restriction.
We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Access to Data Controlled by our Clients
In many cases Pitcher collects information under the direction of its clients, and has no direct relationship with the individuals whose personal data it processes.
Pitcher acknowledges that you have certaint rights related to your privacy. However, in the cases when Pitcher processes personal data on behalf of its Clients, to use your rights you have to contact our Client, who entrusted your data to us. For information we collect for our clients, if you are a customer of one of our Clients and would no longer like to be contacted by one of our Clients that use our sServices, please contact the client that you interact with directly. If the Client requests Pitcher to remove the data, we will respond to their request within 30 business days.
Services Provider, Sub-Processors/Onward Transfer
Pitcher may transfer Personal Information to companies that help us provide our Service.
Transfers to subsequent third parties are covered by the provisions in this Policy regarding notice and choice and the service agreements with our Clients.
Data Retention related to the Website and Services
We will retain and use your Personal Information for as long as is needed to fulfill the purposes outlined in this Privacy Policy, and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. When we have no further justifiable business need to process your Personal Information we will either delete it, or pseudonymize via cryptographic hash in case of IP addresses, or if this is not possible (for example because your Personal Information has been backed up or archived), we will securely store your information and separate it from any further processing until erasure is possible.
Data collected for the purpose of delivering you a particular service will be processed for the duration of service provision. In some situations your data might be processed longer, e.g. for record keeping purposes or for the pursuing or defending against claims purposes. Then such data won’t be kept longer than 10 years.
Personal data we process on behalf of our Clients we will retain for as long as needed to provide services to our Client. In such cases the retention period is determined by a data processing agreement we conclude with a Client.
Information Sharing
We will share your Personal Information with third parties only in the ways that are described in this privacy policy. We do not sell your Personal Information to third parties.
Services Providers
We may provide your Personal Information to companies that provide services to help us with our business activities such as live chat help, product component or hosting provider, and job application. These companies are authorized (by data processing agreement) to use your Personal Information only as necessary to provide these services to us. We may also disclose your Personal Information to any other third party with your prior consent.
Legal Disclaimer
In certain situations, Pitcher may be required to disclose personal data in response to lawful requests by public authorities, including meeting national security or law enforcement requirements.
We may also disclose your Personal Information as required by law, such as to comply with a subpoena, or similar legal process; when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request; to any other third party with your prior consent to do so.
If Pitcher is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our web site of any change in ownership or uses of your Personal Information, as well as any choices you may have regarding your Personal Information.
Opt-out Preferences
You may opt-out of location-based services at any time by editing the setting at the device level or by emailing us at privacy@pitcher.com.
If you wish to subscribe to our newsletter, we will use your name and email address to send the newsletter to you. Out of respect for your privacy, you may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails.
We send push notifications for download notifications. If you wish to opt out of push notifications, please adjust settings from the device level.
We may provide you the opportunity to participate in questionnaires or surveys. If you participate, we will request certain Personal Information from you. Participation in these questionnaires or surveys is completely voluntary and you therefore have a choice whether or not to disclose this information. In other words, we will process your data from the questionnaires or surveys upon your consent. The requested information typically includes contact information (such as name and shipping address), and demographic information (such as zip code). We use this information to hold field studies.

Technologies such as: cookies, beacons, tags, scripts or similar technologies are used by Pitcher and our marketing partners, affiliates, analytics, online customer support provider and online customer documentation provider. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our user base as a whole. Analytics / Log Files
As is true of most web sites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

We use mobile analytics software to allow us to better understand the functionality of our Mobile Software on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from.
We do not link the information we store within the analytics software to any personally identifiable information you submit within the mobile application. Any IP addresses obtained to determine unique visitor numbers of Pitcher products are pseudonymized through cryptographic hash and are not being transferred to any third party.
Security
The security of your Personal Information and our clients’ information is important to us. When you enter sensitive information, such as user name, password and location based information on the web site or within the app; we encrypt the transmission of that information using secure socket layer technology (TLS).
We follow generally accepted standards to protect the Personal Information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. Our web site offers publicly accessible blogs or community forums that you can comment via a third party application or directly from the site. In some cases, we may not be able to remove your personal data, in which case we will let you know if we are unable to do so and why. Social Media Widgets
Our web site includes Social Media Features, such as the Facebook Like button, Share This buttons for Facebook and Twitter. Single Sign-On
You can log in to our site using sign-in services such as Facebook Connect or an Open ID provider.
